Tetro Systems Inc. (“Tetro”)

Tetro’s mission is to grow the game of golf by enriching your experience and removing obstacles to play. On our quest, we promise to be transparent about the data we collect about you, how we use your data, how your information is shared, how your data is protected and how you can manage your data shared with us.

Introduction

This privacy policy (the “Privacy Policy”) explains the information we collect, how we use and share it, how to manage your privacy controls and your rights in connection with our websites and the related mobile applications (the “Sites”) and services (collectively, the “Services”). Please also read our Terms of Use which sets out the terms governing the Services.

Tetro is headquartered in Calgary, Canada and our Services are provided to you by Tetro Systems Inc. If you are a resident of the European Economic Area (“EEA”), Tetro Systems Inc. is the controller of your personal data for the purposes of EEA data protection law.

This policy was written in English. To the extent a translated version conflicts with the English version, the English version controls. Unless indicated otherwise, this Privacy Policy does not apply to third party products or services or the practices of companies that we do not own or control, including other companies you might interact with on or through the Services.

Tetro (“we” or “us”) can modify this Privacy Policy, and if we make material changes to it, we will provide notice through our Services, or by other means, to provide you the opportunity to review the changes before they become effective. If you object to any changes, you may close your account. If you wish to close your account, you can email support@tetro.golf by providing the first name, last name and email address associated with your account and we will process your request.

 

1.     Information Tetro Collects

Tetro collects information about you, including information that directly or indirectly identifies you, if you or your other members choose to share it with Tetro. We receive information in a few different ways, including when you schedule activities using the Services. Tetro also collects information about how you use the Services. There are also opportunities for you to share information about yourself, your friends, and your activities with Tetro when you schedule and/or comment on rounds.

Account, Profile, Activity, and Use Information

We collect basic account information such as your name, email address, and password that helps secure and provide you with access to our Services. In addition, it also enables us to respond to support requests and comments as well to provide you updates with respect to our Services.

Profile, activity and use information is collected about you when you choose to upload a profile picture, send or accept a round invitation (including date, time and location information related to golf rounds) or post in the round comments, or otherwise use the Services. You have the ability to control your profile picture in your settings and a custom profile picture is not required to use an account.

Comments in Round

When you are an Accepted Player or Organizer of a round, you and the other players have the ability make comments on that round or about anything else you choose. These comments are not monitored or analyzed by Tetro and not retained in our databases for longer than twelve months.

“Sharing” A Round

We designed the “Share a Round” feature to respect your privacy and DO NOT collect information about your contacts either stored on the device used to access our Services or web-based application.

Payment Information

When you make a payment on or for Tetro’s Services, you may provide payment information such as your payment card or other payment details to the Apple App Store or Google Play (“App Stores”). The App Stores do not provide any of your payment information to Tetro.

Cookies

We use cookies to enable you to stay signed into our application and count how many times you logged on. That’s it. You are always free to set your browser to decline cookies and you can delete them from your computer. If you decline “cookies” or delete them from your computer, you will still be able to access our Site, but you may find that some areas do not work as smoothly as when cookies are enabled on your system.

Other Information

We may collect information from you through third parties, such as when we collect your feedback through surveys.

We may also collect information about you from other golfers such as when they comment on your round within the App.

Providing You Services

Our primary use of your information is to deliver our Sites and Services for you to use.

We also use your information to measure and improve our Services. We look at this data in anonymous and aggregate form to determine things like how many users in total are using a given feature or how many golfers were invited to a round.

During the process of developing, troubleshooting and administering the Site and Services, it may be necessary to look at pieces of your information to improve the Services and user experience, offer you additional information, opportunities and functionality, respond to requests that you make, resolve a problem or dispute, investigate potential security issues, or verify your compliance with our Terms of Use. Also, when you write us to request support, our customer support representatives may look at your information in order to assist you. We may also access and use your information to compare information for accuracy and verify it with third parties or to comply with applicable law or legal process.

Third parties (such as other golfers in your round) may share information to the Services and share pieces of your information through the comments and other features. It is up to you as to whether you share this optional information — none of it is required, but you may need to coordinate with your fellow golfers to limit any information sharing. Comments are not monitored or analyzed by Tetro and not retained in our databases for longer than twelve months.

Communicate With You

We use your email address to deliver our Services. These notifications are delivered by Tetro but are created by our players such as network requests, round invitations and round update information.

We may use your information to send you marketing communications, communicate with you about our Sites and Services and let you know about our policies and terms. We also use your information to respond to you when you contact us.

Manage the Security of our Sites and Services

We monitor the data to ensure that users are complying with our terms of service and to investigate suspicious behavior on our Sites and Services.

Aggregate and Anonymous Information

We do not sell your personal information. Tetro may aggregate the information you and others make available in connection with the Services and post it publicly or share it with third parties. Examples of the type of information we may aggregate include information about usage, demographics, frequency and location of golf rounds. Tetro may use, sell, license, and share this aggregated, anonymous information with third parties for research, business or other purposes such as to promote golf, golf courses, help our partners understand more about golfers, including the people who use their products and services.

 

3.     How Information is Shared

In addition to sharing aggregated data about our golfers as described above, we also share personal information in accordance with your preferences, as needed to run our business and provide the Services, and where required for legal purposes, as set forth below.

Service Providers

We may share your information with third parties who provide services to Tetro such as supporting, improving, promoting and securing the Services, processing payments, or fulfilling orders. These service providers only have access to the information necessary to perform these limited functions on our behalf and are required to protect and secure your information. We may also engage service providers to collect information about your use of the Services over time on our behalf so that we or they may promote Tetro or display information that may be relevant to your interests on the Services or other websites or services.

Publicly Available Information

When you join Tetro, your name and profile photo are viewable by other golfers should they search for you in order to enable connection. No other information is made publicly available.

Sharing Information and Activities

As a social network, we share calendar and location information of a round of golf with your other Tetro connections for the purpose of scheduling a round.

Affiliates and Acquirors of our Business or Assets

We may share your information with affiliates under common control with us, who are required to comply with the terms of this Privacy Policy with regard to your information. If Tetro becomes involved in a business combination, securities offering, bankruptcy, reorganization, dissolution or other similar transaction, we may share or transfer your information in connection with such transaction.

Legal Requirements

We may preserve and share your information with third parties, including law enforcement, public or governmental agencies, or private litigants, within or outside your country of residence, if we determine that such disclosure is allowed by the law or reasonably necessary to comply with the law, including to respond to court orders, warrants, subpoenas, or other legal or regulatory process. We may also retain, preserve or disclose your information if we determine that this is reasonably necessary or appropriate to prevent any person from death or serious bodily injury, to address issues of national security or other issues of public importance, to prevent or detect violations of our Terms of Use or fraud or abuse of Tetro or its members, or to protect our operations or our property or other legal rights, including by disclosure to our legal counsel and other consultants and third parties in connection with actual or potential litigation.

 

4.     How We Protect Information

We take several measures to safeguard the collection, transmission and storage of the data we collect. However, it is our practice to prevent the opportunity for a significant compromise of information by limiting the personal information we collect.  For the limited information we do collect, we employ reasonable protections for your information that are appropriate to its sensitivity. The Services use industry standard Secure Sockets Layer (SSL) technology to allow for the encryption of personal information. Tetro partners with industry leaders in online security, including Services verification, to strengthen the security of our Services. We do not collect payment information but rely on industry leaders in payment processing (i.e. the App Stores) to collect any and all fees.  The Services are registered with site identification authorities so that your browser can confirm Tetro’s identity before any personal information is sent. In addition, Tetro’s secure servers protect this information using advanced firewall technology.

 

5.     Managing Your Information

Privacy Controls and Email Notifications

The only members that can see what rounds you are playing are other invited players to that specific round and the organizer of that round.

You have control over who is connected with you in Tetro. Other players cannot invite you to a round unless you authorize them to be a connection. If you no longer want to be connected to a specific person, you can remove them from your network at any time.

Currently our application is solely web-based and have not yet launched a mobile application and we don’t have the ability to perform “Push Notifications”. As such, we use email to notify you about events other players of Tetro have created (examples: Network Requests and Round Invitations). These notifications are necessary for providing you our Service.

Know that we are currently working on a mobile application that will enable Push Notifications and allow you to opt out of email notifications.

If you no longer wish to receive emails about events in Tetro, please email support@tetro.golf. Just remember you might miss out on a round if we turn that feature off.

Any administrative or service-related emails (to confirm a purchase, or an update to this Privacy Policy or our Terms of Use, etc.) generally do not offer an option to unsubscribe as they are necessary to provide the Services you requested.

Updating Account Information

You may correct, amend or update profile or account information at any time by adjusting that information in your account settings. If you need further assistance correcting inaccurate information, please contact Tetro at support@tetro.golf. Tetro will generally respond to your request within 10-14 business days.

Deleting Information and Accounts and Downloading Your Data

You can delete your account or request all the data we have related to your account by emailing support@tetro.golf.

After you make a deletion request, we permanently and irreversibly delete your personal data from our systems, including backups. Once deleted, your data, including your account, your rounds and comments cannot be reinstated. Following your deletion of your account, it may take up to 90 days to delete your personal information and system logs from our systems. Additionally, we may retain information where deletion requests are made to comply with the law and take other actions permitted by law.

Note that content you have shared with others, such as photos, or that others have copied may also remain visible after you have deleted your account or deleted specific information from your own profile. Your public profile may be displayed in search engine results until the search engine refreshes its cache.

Your Rights

Your personal information is always yours. Subject to any legal or regulatory requirements that may restrict us from providing access to any information we have collected, you have the right to access personal information, have it corrected, or have it deleted, and to let us know if you have any concerns about how we protect it. To exercise your right to access your personal information, or to correct or delete it, please contact us at support@tetro.golf.

Our Legal Bases

Tetro relies on a number of legal bases to collect, use, share, and otherwise process the information we have about you for the purposes described in this Privacy Policy, including:

  • As necessary to provide the Services and fulfill our obligations pursuant to the Terms of Use. For example, we cannot provide the Services unless we collect and use your scheduling information;
  • For external processing with our affiliates or other trusted businesses or persons to process it for us, based on our instructions and in compliance with our Privacy Policy;
  • If we undergo a business transaction such as a merger, acquisition or other transaction where we may share or transfer your information with a third party or parties in connection therewith;
  • Where you have consented to the processing;
  • Where necessary to comply with a legal obligation, a court order, or to exercise and defend legal claims;
  • To protect your vital interests, or those of others, such as in the case of emergencies; and
  • Where necessary for the purposes of Tetro’s or a third party’s legitimate interest, such as our interests in protecting our members, our partners’ interests in collaborating with our members, and our commercial interests in ensuring the sustainability of the Services.

Transfers

The Services are operated from the Canada. If you are located outside of Canada and choose to use the Services or provide information to us, you acknowledge and understand that your information will be transferred, processed and stored in the Canada, as it is necessary to provide the Services and perform the Terms of Use. Canadian privacy laws may not be as protective as those in your jurisdiction.

Retention of Information

We retain information as long as it is necessary and relevant for our operations. Typically we retain information until it is deleted by the golfer so that we can perform our Services. In addition, we may retain your information from closed accounts to comply with the law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigation, enforce our Terms of Use and take other actions permitted by law.

Information connected to you that is no longer necessary and relevant to provide our Services may be de-identified or aggregated with other non-personal data to provide insights which are commercially valuable to Tetro, such as statistics of the use of the Services. For example, we may retain booking information related to golf courses, use of the Services, etc. to continue to improve the Services. This information will be de-associated with your name and other identifiers.

Children’s Privacy

Tetro does not knowingly collect information from children under the age of 13. Furthermore, we do not target our service to children under these ages nor do we knowingly communicate with children under 13.

Sensitive Information

We ask that you not send us, and you not disclose, any sensitive information (e.g., government identifiers, information related to racial or ethnic origin, political opinions, religion or other beliefs, biometrics or genetic characteristics or trade union membership) on or through the Services or otherwise to us.

Privacy Policy Information

Tetro reserves the right to modify this Privacy Policy at any time. Please review it occasionally. If Tetro makes changes to this Privacy Policy, the updated Privacy Policy will be posted on the Services in a timely manner and, if we make material changes, we will provide a prominent notice. If you object to any of the changes to this Privacy Policy, you should stop using the Services and you can contact support@tetro.golf to delete your account.
